Workplace gossip, bullying didn't force employee's resignation

An employee has failed to prove she was forced to resign for the sake of her mental health, alleging she was bullied and falsely accused of misconduct.

In April this year, Dorevitch Pathology received complaints that the team leader had made persistent and intimidating phone calls to staff, during which she would yell at them.

After the employer told her it would investigate the allegations – which she denied – she went on sick leave.

A few weeks later, an HR professional called the employee to say she wasn't going to be dismissed, while foreshadowing other disciplinary action. He asked her to return to work to attend a meeting, but she declined...
