Weekly meetings weren't a "performance appraisal", psych claim upheld

A commission has rejected that weekly meetings with a probationary employee were a "performance appraisal" that exempted an employer from liability for his psychological injury.

The TAL Services claims consultant was certified as incapacitated for work in November 2022 and subsequently claimed compensation for a psychological injury he alleged arose as a result of bullying and harassment by a new manager.

The employer accepted he had sustained an adjustment disorder, however it disputed liability on the basis the injury was wholly or predominately caused by performance appraisal, not bullying...
