Union wins EA dispute over employer's recruitment process

A Fair Work Commission full bench has upheld a union's appeal regarding its right to be involved in an employer's recruitment and selection process.

In July last year, mining company Batchfire Callide Management's new enterprise agreement came into effect, and it started discussing with the CFMMEU the process for filling 10 vacant positions.

The employer didn't want to go through an interview process, so the parties agreed on conducting a "fair and transparent" scoring system, in which prospective employees were ranked and the top 10 – all labour hire employees – were offered permanent roles...
