When a general manager sent an employee more than 200 "inappropriate" messages out of work hours he effectively sacked him, the Fair Work Commission has found.
Deputy President Nicholas Lake rejected Organic Life Distribution's jurisdictional objection to the delivery driver's adverse action claim, finding the GM's "numerous messages of concern", which included a reference to self-harm, amounted to dismissal at the employer's initiative.
He found the GM's conduct "seriously damaged the employment relationship" and made the worker's continuing employment "untenable"...
