Reducing hours was 'punishment' for underpayments complaint

A casual employee who complained about being underpaid and was then punished with reduced hours had no real choice but to resign, the Fair Work Commission has ruled.

The casual waiter/host was employed at café White Rabbit Kiaora Lane until his resignation on 12 September 2023, which he claimed was a constructive dismissal.

But the employer raised a jurisdictional objection to his general protections claim, arguing the employee had not been sacked...
