Redeployment opportunity was "acceptable" despite pay cut, loss of seniority

Redeployment offers do not need to be "identical" but rather "sufficiently comparable" to a redundant role, the Fair Work Commission has ruled in reducing an employee's redundancy payout by 50%.

In July this year, the Australian College of Optometry applied to the FWC seeking to reduce the redundancy pay it owed its visual services clinic manager, whose position became redundant in a company restructure.

Having worked for the employer for over 10 years, the employee was entitled to 12 weeks' pay, amounting to $12,331.

The employer told the Commission that during its consultation process it had identified a "staff optometrist" position as a suitable alternative to the employee's former role...
