Pregnant casual sacked after following medical advice

An employer effectively dismissed a pregnant casual when it removed all of her shifts after she refused to pick up a customer order, which she believed would have exceeded her safe lifting capability, the Fair Work Commission has ruled.

The casual employee worked at Kingsley's Chicken for five-and-a-half years, before she was removed from the roster in September last year.

She subsequently made a general protections claim involving dismissal, arguing the employer discriminated against her because of her pregnancy and took adverse action against her because she exercised a workplace right by taking personal leave and consulting a lawyer...
