Managers consistently dealt with an employee's work mistakes in a "positive, encouraging and supportive manner", even while dealing with numerous customer complaints, the Fair Work Commission has found in unfair dismissal proceedings.
Fuchs Lubricants sacked the account manager in August last year for failing to: improve his order accuracy so customers didn't run out of oil; regularly update the customer relationship management database; and achieve performance improvement plan objectives.
The employee subsequently claimed unfair dismissal, arguing the employer subjected him to unreasonable performance management. He told the Commission the warnings he received "gave the impression that the [employer] was doing the right thing by him when in truth it was setting him up for failure"...
