Non-attendance on mandated office days didn't warrant dismissal

An employer that questioned a "high-achieving" employee's commitment to his role after he worked from home on mandatory in-office days has been ordered to pay him more than $26k in compensation for unfair dismissal.

The digital growth associate for e-commerce service provider, Insider, told the Fair Work Commission his dismissal in September last year wasn't valid or procedurally fair; he had never been warned about any conduct or performance issues during his employment, nor had he been notified of the dismissal reason.

In its defence, the employer argued that on Wednesday 30 August, the employee had worked from home without prior notice and had dismissed its attempts to address the matter...
