Meeting walk-out during "extreme pressure" wasn't a resignation

An employee with ADHD has claimed a disciplinary meeting was so distressing she had to walk out, with the Fair Work Commission accepting this wasn't a resignation.

After the Crust Bakery Café employee claimed she was unfairly dismissed in March this year, the employer objected on the basis she had voluntarily resigned.

The Commission heard that in February, the employee started complaining about her new manager. According to the employer, she disregarded the manager's advice, "tried to shame him" in front of colleagues, wouldn't let him make coffee during busy periods, refused to take breaks when asked, and told him off when he used his phone at work.

On one occasion the manager asked her how long she'd take to clean the ovens, so he could organise breaks, and the employee responded in an evasive and angry manner before walking off...
