Manager "unquestionably" used position for personal gain: court

A manager and his "alter ego" company have been ordered to pay his former employer $474k, after a court found he breached his fiduciary duty not to use his position for personal gain.

In April 2019, the employer – I C Pipes – raised concerns with the NSW contract manager that it wasn't receiving invoices for work being performed by a subcontractor, DGS Trading.

The manager subsequently set up a process to deal with payments to DGS, which included confirming amounts, preparing invoices, and submitting them to the employer for payment...
