A worker claiming she was unfairly dismissed has won an appeal, with the Fair Work Commission finding an earlier ruling that she earned above the high-income threshold was made in error.
The worker was engaged by recruitment company Hays, through contractor payroll platform PayMe, to provide her services to Hays' client Filosoph-e. The engagement started in November 2020 and ended more than a year later, by which time her hourly rate was $104.97.
When the worker claimed unfair dismissal Hays lodged a jurisdictional objection on five grounds, arguing that she: lodged her application outside the required timeframe; wasn't an employee; wasn't dismissed; had not completed the minimum employment period; and earned more than the high-income threshold...
