FWC slams "unscrupulous" employer over serious misconduct dismissal

The Fair Work Commission has lambasted an employer for its "unconscionable and unscrupulous" attempt to deny a sacked employee any remedy for unfair dismissal.

In October 2020, the Amigoss Preschool and Long Day Care early childhood teacher was called into a "without prejudice" meeting to discuss her alleged poor performance, and she was given the option of resigning or undergoing a disciplinary process.

The CEO told her that parents had complained about her, although he didn't provide details, and he made it clear he felt the employment relationship had become untenable.

He sought her response by the end of the day, but she went on leave and informed him that she would only reply when she had more details about the allegations...
