FWC addresses "complex" issue in stop sexual harassment ruling

In a new decision under the Fair Work Act's powers to order sexual harassment to stop, a Deputy President has examined when harassment will be deemed to have occurred "at work".

The Riverton Bar & Grill kitchen hand applied for stop harassment orders late last year, shortly after the new provisions came into effect, claiming the manager had taken advantage of his position and created a hostile work environment.

The employee claimed that around October 2021, the manager started attending her house – without being asked – to drive her to work, and would return her home at the end of her shift.

She then started recording some of their conversations, four of which she provided to the Commission as part of her application...
