"Extremely unfair" to sack employee over historical poor performance

It was "extremely unfair" for an employer to rely on historical – and resolved – performance issues when dismissing an employee, the Fair Work Commission has ruled in awarding him maximum compensation.

Deputy President Bryce Cross found the employer accepted complaints about the employee "without question", while disregarding his "cogent" responses.
