"Exceptionally driven" employee was not forced to resign

An employee who threatened to make a general protections claim if her employer didn't agree to her separation terms was not forced to resign, the Fair Work Commission has ruled.

In 2022 the Acton Mandurah real estate sales agent, who accused her employer of failing to act on various complaints about other staff, warned that if her terms weren't accepted, her lawyer was "standing by".

In arguing that she had been forced to resign, the employee told Deputy President Melanie Binet that in the months leading up to her resignation, a senior sales administrator had treated her rudely and with hostility, jeopardising her sales by refusing to prioritise her work. She said she reported her concerns to the director on at least 10 occasions, but he was unresponsive...
