"Exasperating" employee wasn't sacked because of undisclosed disability

It was unfair of an employee not to tell his employer about a mental disability that could affect his work performance, the Federal Circuit Court has ruled in adverse action proceedings.

The Condor Energy Services assistant accountant was dismissed in November 2019, during his six-month probation period, for ongoing negative and disruptive behaviour.

The employee subsequently claimed adverse action, arguing the real reason his employment was terminated was because he had a mental disability...
