Employer engineered "sham" redundancy after workplace complaints

An employer has failed to prove a team restructure and an employee's subsequent redundancy weren't motivated by his numerous workplace complaints.

The Monash Health medical librarian claimed his role was made redundant in January 2020 because he'd complained about:

  • not being reclassified to a higher position and backpaid to 2012, for working at the higher level since that time. (Monash Health repeatedly rejected his requests, but eventually agreed after he took the matter to the Fair Work Commission);
  • being targeted for redundancy; and
  • being discriminated against because of his FWC claim.

The employee also accused the Monash Doctors Education director and his manager, among others, of bullying, discrimination and harassment...
