Employer accused of 'reckless endangerment' after refusing leave

An employee has accused his employer of "recklessly endangering" him when it rejected his request to take time off for an appointment during the busy festive season.

The maintenance planner worked for Rio Tinto Alcan Gove until his resignation in December last year, and he subsequently submitted a general protections claim contending he had been left with no choice but to quit so he could attend a medical appointment in Perth.

But the employer denied constructively dismissing the employee.

The Commission heard that in mid-November, the employee sought annual leave for 27–29 December, however his request had no reason attached to it...
