Employee unfairly sacked following HR manager's "poor" advice

An HR manager has been criticised for giving "poor" advice that an employee should be sacked for breaching an "inherent requirement" of his position description.

South Australian Employment Tribunal Deputy President Stephen Lieschke said the employee's dismissal was the result of a "confused" allegation regarding a document that, "at a fundamental level", could not be breached, and a failure to consider alternative options.

In January this year, the construction worker told his employer, City of Victor Harbor, that he had lost his driver's licence for 12 months due to a drink-driving offence...
