An employer must pay an employee nearly $40k in compensation for unfair dismissal, after the Fair Work Commission found it sacked him via email and then invited him to "re-apply" for his role.
In August last year, Drewmaster dismissed the electrician, who had been working at the Palmer Coolum Resort, along with 125 other construction employees, after discovering the workforce allegedly didn't intend on working required site hours.
The employee's termination letter stated it had "no choice" but to dismiss him for refusing to carry out his duties as directed; it also mentioned a "substantial site investigation" had uncovered widespread fraud, theft and dishonesty...
