Employee's abusive conduct outweighed HR's unfair process

An employee has failed to prove he was unfairly sacked for abusive conduct, despite the Fair Work Commission finding the HR team's investigation and workplace training processes were "obviously inadequate".

In August last year, The Good Guys sacked the sales representative for serious misconduct, after he swore at a customer.

The employee claimed unfair dismissal, arguing that while his language was inappropriate, the customer had been the aggressor...
