Employee had "understandable emotional reaction" to harassment allegations

An employee's "understandable" response to s-xual harassment allegations against him wasn't "outside the boundaries of normal mental function", a tribunal has ruled in rejecting his workers' compensation claim.

In September 2020, K&S Freighters was informed that the truck driver had been accused of sexually harassing a worker at a client's site.

A week later, the client – Ingham's Enterprises – told the employer it had investigated the allegations, and that it didn't want the employee attending its sites in future.

The employer requested details of the allegations for its own investigation, and subsequently sought the employee's response. The allegations included that he: had tried to give the worker a necklace; repeatedly made a hand gesture to her that was interpreted to mean "I love you"; asked the worker multiple times to go away for weekend trips; and had attempted to kiss her...
