Email silence, cancelling shifts didn't constitute bullying: FWC

A worker has failed to prove she was bullied by a manager who didn't respond to her lengthy "feedback" email, cancelled her shifts, and then stopped offering her more work.

The VetPartners Australia locum veterinarian sought stop-bullying orders against the organisation and a general manager, alleging she experienced three instances of unreasonable behaviour.

Her allegations related to: a lack of response to emails she sent managers in December last year; six of her shifts being cancelled over the Christmas/New Year period; and her employment relationship ending in January.

Fair Work Commission Deputy President Val Gostencnik accepted at the outset that the worker held a "reasonable" belief that she had been bullied, "in the sense that the belief has some rational basis to support it"...
