Colleague's "rebarbative behaviours" didn't force employee to resign

An employee voluntarily resigned before her employer had the opportunity to rectify its mistake in rostering her on with a colleague she claimed was bullying her, the Fair Work Commission has ruled.

The Forhealth Group registered nurse complained that she repeatedly reported "persistent" workplace bullying to her supervisors, but they failed to address the behaviour, which left her with no option but to resign.

After resigning in December last year, the employee filed a general protections application involving dismissal, but the employer objected on the basis her decision was voluntary.

The employee told the Commission that a colleague targeted her from her first day at the company; the colleague spoke badly about her to others, yelled at her, excluded her, and treated her differently to other staff...
