CEO perceived workplace to be "hostile", psych claim upheld

A managing director has failed to disprove allegations he intimidated, excluded and swore at his employer's CEO, with a commission finding these "actual events" created the perception of a hostile workplace.

The CEO had worked for NF Importers from February 2019 until March 2023 when he was certified as incapacitated for work, and he subsequently sought workers' compensation for a psychological injury.

But the employer denied liability, disputing the CEO had suffered an injury in the course of his employment.

The CEO told the NSW Personal Injury Commission there had been a change in the company environment in the last six months of his employment, which led to numerous disagreements between himself and the managing director...
