Candidate claims recruitment process, AI algorithm breached privacy laws

A candidate is claiming an employer should have determined her "employability" based on details included in her resume, and not from an "inaccurate" personality assessment made by artificial intelligence.

The candidate applied for a role in the Victorian Department of Jobs, Precincts and Regions' digital jobs program, through a hiring campaign managed by Hudson Global Resources.

Although successful, she subsequently claimed that both during and after the recruitment process, the Department breached numerous information privacy principles (IPPs) set out in the State's Privacy and Data Protection Act.

But the Department sought for her complaint to be summarily dismissed on the basis it was "frivolous, vexatious, misconceived, lacking in substance or an abuse of process"...
