'Bullied' employee was unable to accept performance failures

Having one member of a small team repeatedly fail to meet project timelines was "a situation that any business would need to address", the Fair Work Commission has noted in rejecting an employee's stop-bullying claim.

The payroll analyst sought stop-bullying orders against her manager (all parties were anonymised during proceedings) arguing that during an informal performance management process she was subject to "undue criticism".

She claimed that until she was assigned an 'ops task' in May 2021, no performance concerns had been raised during her nine months in the role. With that particular task, she told the FWC she didn't receive the relevant data or any training, and was given an unreasonable timeframe to complete the job...
