Bottom slap, declaration of feelings cost employer $268k

A director s-xually harassed an employee when he slapped her on the bottom and twice declared his feelings for her, the Federal Court has found in ordering his employer to pay $268k in damages and compensation.

This decision is significant, as it "sets a record for the highest general damages awarded in a sexual harassment matter" under the Commonwealth Sex Discrimination Act, according to Maurice Blackburn Lawyers principal Mia Pantechis, who represented the employee.

"It is an important step towards increasing compensation awards in sexual harassment matters," she tells HR Daily.

"Too often, victims are met with aggressive behaviours when they complain to deter them from pursuing their rights. These behaviours exacerbate the harm and humiliation suffered. The Court has sanctioned such tactics by awarding additional damages..."
