"Strict compliance" with workplace relationship policy was unreasonable

It wasn't reasonable for an employer to enforce "strict compliance" with its policies in requiring a managing director to disclose his relationship with a subordinate, a tribunal has ruled.

In February last year, Amobee ANZ Pty Ltd dismissed the MD for reasons that included his failure to comply with its 'conflict policy'.

That policy required staff to "avoid all situations that will or have a potential, to give rise to a conflict of interest" (such as a relationship between a supervisor and subordinate), and to notify HR of potential conflicts.

The MD subsequently lodged a complaint of disability discrimination by association with the Anti-Discrimination Board of NSW, which was initially accepted but later declined on the basis it was "lacking in substance"...
