Thorough planning critical before workplace investigations: lawyer

Not every instance or allegation of inappropriate workplace behaviour requires a "full-blown" workplace investigation, an employment lawyer says.

"The starting point here to remember is that investigations are for conduct issues... They shouldn't be used to manage or assess instances of poor performance," Ashurst partner Tamara Lutvey tells a new HR Daily Premium webcast.

Scenarios when a formal investigation will be appropriate include where the allegations that have been presented "could amount to misconduct; could be a breach of a standard of conduct or a policy or procedure; if there's a safety breach involved; or if you would be potentially contemplating disciplinary action", Lutvey explains...
