Removing shifts during "major reorganisation" wasn't a dismissal

Removing a casual worker from a group chat and reassigning her "regular" shifts to other employees didn't constitute a dismissal, the Fair Work Commission has found.

In September last year, the patient services employee told CMH Practice Management that she believed she was working at a higher classification level under the relevant award and should therefore be reclassified and paid more.

At that time, the employee had been working weekend shifts once per month and other shifts on an irregular basis.

The employer told her in early November that "due to changes in the business" it could no longer offer her casual shifts, however it encouraged her to remain in its casual pool and said there might be further shifts available in the holiday period...
