No reason for stop-SH orders after alleged harasser resigned: FWC

An application for orders to stop s-xual harassment had no reasonable prospects of success after the employee accused of sending "vile" messages resigned, the Fair Work Commission has ruled.

As with stop-bullying applications, the absence of a party from the workplace will often remove the risk of the behaviour continuing, Commissioner Jennifer Hunt said in her judgment.

The application was made by a minor, employed by Port City Meats and assisted in his application by his stepfather. Last month, Commissioner Hunt issued a confidentiality order that he must not be named or identified other than as 'Mr AB', but in her ruling she named the coworker against whom the orders were sought...
