Leaving work mid-shift wasn't abandonment of employment

An employer that accused a worker of abandoning her employment and causing it to lose customers will have to face her general protections claim, after the Fair Work Commission found it dismissed her.

Asami Pty Ltd had objected to the chef's claim, arguing she hadn't been dismissed but had abandoned her employment when she left work during her rostered hours and didn't return.

The Commission heard that prior to her shift on 22 January this year, the employee had a conversation with one of the employer's co-owners regarding her hours of work and other matters...
