Investigation documents might point to future bullying risks

The Fair Work Commission has granted a worker's request for copies of emails, notes and reports related to her employer's internal processes, as part of her stop-bullying claim.

After making her stop-bullying application, the Central Queensland Services worker sought the production of a broad array of documents that she alleged related to her claim, including details of its "grossly unfair" investigations into her bullying complaints, an audit of her leave entitlements, and hours worked by certain employees.

The worker told the Commission that the documents she was seeking, under section 590 of the Fair Work Act, might help her to demonstrate that the alleged bullying behaviour took place, particularly in the form of "favouritism or nepotism" that resulted in preferential treatment of some workers, and unfavourable treatment of her...
