"Elderly" director an unlikely bullying risk: FWC

The Fair Work Commission has dismissed a senior manager's stop-bullying claim after finding he deliberately forestalled proceedings to preserve his employment, and noting it had "reservations" about whether he was capable of being bullied by an "elderly" director.

The Seahill Enterprises operations manager lodged a stop-bullying claim against its sole director in 2020. According to his application he had an "unusually strong" employment relationship with the director such that she involved him in her family-related legal affairs, but in recent months, her attitude towards him had changed.

He sought orders compelling the director to complete a bullying and harassment course, apologise in writing for her behaviour, and speak to him directly when she had a problem "rather than her current behaviour"...
