Employees are becoming more "energised" to advocate for their workplace rights and the Fair Work Commission's first equal pay ruling has important lessons on preventing and defending these types of claims, a lawyer says.
The full bench decision, handed down this week, reflects the Commission's increased focus on dealing with gender inequality and equal pay, Colin Biggers & Paisley partner Adam Foster says.
He says the bench spent time delving into the Fair Work Act's equal remuneration provisions and "elaborating what their views are to give workers and employers a bit of a signal as to how they would approach equal pay and remuneration issues in the future"...
