"Botched" process made underperforming manager's sacking unfair

An employer was entitled to dismiss a manager for performance and conduct issues, but its failure to give him time to improve and its "near total lack of procedural fairness" made its decision unfair.

In his first two months of employment, Duo Trading's area sales manager performed well, generating around $15k and $17k in sales respectively, and the employer recognised this by increasing his annual base salary by $10k, to $80k.

In the following two months, however, his sales performance "slumped" to $4k and $9k...
