Arrest at workplace 'not a surprise'; dismissal ruled fair

Being publicly arrested at work was a valid reason for dismissal, because the employee knew he was a 'person of interest' to police but attended his workplace anyway, the Fair Work Commission has found.

Deputy President Richard Clancy found that because police had visited the employee's home and he hadn't answered the door, but went to work the next day without notifying his employer, he acted "wholly indifferent to the employer's brand and reputation as an aged care provider".

The DPG Services employee, who worked as a maintenance officer at an Opal care home, was arrested on site in relation to an alleged domestic violence incident involving his ex-partner...
