"Uncompromising" and "abrasive" senior executive was unfairly sacked

A director who could at times be "uncompromising, argumentative or abrasive" has won reinstatement, continuity of service, and $87k in backpay and compensation, after the Fair Work Commission found his dismissal for serious misconduct was unfair.

In July last year, Low Latency Media Pty Ltd sacked the chief technology officer, who was its sole director and had jointly founded the company a few years earlier.

The employer alleged, among other things, that the director: publicly disparaged the chief operations and chief financial officers during a meeting; told a junior employee that they were a "useless c-nt and a waste of the company's money"; and told staff to "disregard everything the other executives say".

In claiming unfair dismissal, the director denied all of the allegations, said the employer had no valid reason to sack him, and sought reinstatement...
